If your neighbours have thwarted your plans to extend your home by objecting to your planning application don’t despair, Planning Direct could help you win at Appeal.
Planning Direct was approached in May 2108 by a couple who had just been refused planning permission. This couple wanted to build a roof terrace to the rear of their building, but were refused by the council on the following grounds
impact on the amenity of neighbours
character and appearance of the development.
They instructed Planning Direct to submit an Appeal. The statement produced by Planning Direct in support of their application referenced all Neighbours complaints and addressed all issues raised in the Council’s decision notice. On the basis of these very clear arguments the Inspector granted their Appeal.
The Inspector’s decision letter makes it clear that the proposal is in line with local policy, contrary to the view of the council, and therefore he has approved the permission. This was assisted by the presence of an existing roof terrace next door, and despite a previous appeal decision refusing a roof terrace by their other neighbours.
If your neighbours have objected to development to your property this doesn’t mean that you’re being unreasonable and you aren’t necessarily wrong. It might be that they are. A planning consultancy such as planning direct can often quash objections using policy and reasoning. For this couple, this means a roof terrace for entertaining, improving their quality of life, will now be built in accordance local and national policy and in line with building regulations.
Here’s what our client had to say;
